“1894 revision of the state constitution declares all forms of gambling,
including lotteries illegal. One year later the legislature approved the
Percy- Grey law which Governor Hughes describes a ’Simply a trick-a cunning trick
devised not for the purpose of regulating vice, but for the purpose of
affording the opportunity to make money out of gambling privileges through unjust
and hypocritical discriminations”. Percy- Grey forbids pool selling and book
making at race tracks and authorizes special police to stop gambling. In
practice, it imposes no real penalty on violators. the most a citizen can do is
sue to recover the exact amount he lost
